These terms & conditions set out the basis on which you can visit and use our website www.godivachocolates.co.uk ("website"). Please read them carefully as they contain important information.

This website is owned and operated by Godiva UK - Limited with company number 00356451 ("Godiva UK", "we" or "us") whose registered office is Canal Level, 102 Camley Street, Camden, London N1C 4PF.
You are provided access to this website in accordance with these terms and conditions. There may be legal notices on other areas of this website which relate to your use of this website, all of which will, together with these terms and conditions govern your use of this website. If you choose to access this website from outside the United Kingdom, you are responsible for compliance with laws of the country from which you access this website. We reserve the right at any time to: modify or withdraw this website (or any part thereof) without notice to you and we shall not be liable to you for any such modification or withdrawal; and/or change these terms and conditions from time to time and your continued use of this website (or any part thereof) following such change will be deemed to be your acceptance of such change. Each time you place an order with us, you should check these terms and conditions to ensure you understand the terms which apply at that time. By placing any orders through our website, you warrant that: you are legally capable of entering into binding contracts; the personal information which you provide when you register as a customer is true, accurate, current and complete in all respects; and you agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.

2.Terms and Conditions of Sale
All products shown on our website are subject to availability.
Please note that whilst we make all reasonable efforts to ensure that all descriptions and graphical representations of the products correspond to the actual products, images of goods are for illustrative purposes only and your products may vary slightly from those images. We reserve the right to change prices and to add, modify or remove any special offers through our website at any time.
Please be advised that our products may contain allergens, including: milk, eggs, soy, nuts and gluten.
Placing an order
When placing an order with us you are requested to read and agree to these terms and conditions. Any orders placed by you must be placed in accordance with these terms and conditions. If you are unsure about any of the content of our terms and conditions please contact Customer Services at customerserviceUK@godiva.com or call us on +44 (0) 208 078 6862 before you place an order. You must be over 16 to place an order, or over 18 in the case of chocolates containing alcohol.
Acceptance of your order
After receipt of your order we will send you an order acknowledgement email detailing the product(s) you have ordered and confirming the prices of the products. If you do not receive this order acknowledgement email within 5 days of placing your order please contact Customer Services at customerserviceUK@godiva.com or call us on +44 (0) 208 078 6862.
The order acknowledgement email is not an acceptance of your order. Acceptance of your order and formation of the contract will only take place once we have confirmed your credit or debit card authorisation for your order and we have sent you a dispatch confirmation email confirming that the products you have ordered have been dispatched from our warehouse.
We reserve the right to decline any order you place. If we, for any reason, do not accept or cannot fulfill your order, no payment shall be taken under normal circumstances. If we have taken payment any such sums shall be refunded as soon as possible and in any event within 14 days.
Delivery, Risk and Ownership
Your order will be fulfilled by the estimated delivery date set out in the dispatch confirmation, unless prevented by circumstances beyond our reasonable control. If we are unable to meet the estimated delivery date because of such circumstances, we will contact you with a revised estimated delivery date. Whilst we make every effort to deliver all your goods in the agreed time, we will not be liable if we fail to do so in part or in full due to circumstances beyond our control.
We will deliver the products to the address you give us. Delivery will be completed once we have delivered the products to the address including, where relevant, any alternative address provided in your order.
If we are unable to deliver the products on the delivery date (if, for example, no one is available at your address to receive the products) we will follow any delivery instruction you may have given or attempt to leave your products in a safe place. If this is not possible, our carrier will leave a note advising of where your products have been returned to, and how to either arrange a re-delivery or collect them.
The products will be your responsibility from completion of delivery.
You shall only own the products once we have received payment in full of all sums due in respect of them, including all delivery charges if applicable.
This returns policy is specific to online purchases by consumers, it is not applicable to any purchases made in a Godiva UK store or concession or to purchases made by businesses. We are as passionate about customer satisfaction as we are about making chocolate. We hold ourselves to the highest standards…so you can, too. Your order is guaranteed to arrive in perfect condition, no matter the weather, containing the elegant packaging and quality chocolate customers expect from Godiva UK.
If, for any reason, you are not completely satisfied with the condition of your product, or you receive an incorrect product, simply contact us to return your order for a prompt replacement, refund, or exchange. You will be asked for proof of purchase.

Consumer cancellation rights under the Distance Selling Regulations 2000 or the Consumer Contracts Information, Cancellation and Additional Charges Regulations 2013 do not apply to products which have been personalised, or made subject to the buyer’s specifications or which are perishable or liable to deteriorate or expire rapidly. As our products are perishable, and may also have been personalized, these cancellation rights do not apply to sales through this website; however, this does not affect our Returns Policy above.
We will provide products that are of satisfactory quality, fit for purpose and as described at the time of purchase and as a consumer, you have legal rights in relation to products that are faulty or not as described. Nothing in these terms and conditions, including the Returns Policy above, seeks to exclude or limit your legal rights as a consumer. Advice about your legal rights is available from your local Citizens’ Advice Bureau. For both consumers and businesses if we fail to comply with these terms and conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms and conditions or our negligence, but we are not responsible for any loss or damage that is not foreseeable. If you are a business we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity or goodwill whether or not foreseeable.
Nothing in these terms and conditions seeks to limit or exclude our liability for death or personal injury caused by our negligence; or for fraud or fraudulent misrepresentation.
In the event of any dispute, these terms and the agreement between us shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.
